Stage 2 - Planning
01. - PLANNING PERMISSION
Documentation is submitted to the Local Authority at this stage. Submissions [observations and objections] can be made within the first five weeks. The Local Authority requires a minimum of 8 weeks to make a decision.
- All drawings and documentation are produced for submission to the Local Authority
- Coordination of all information with pre-planning advice from the other members of the design team
- Drawings and documentation produced at this time must be approved by the Client prior to submission. This is the information that represents the project to be built subject to the approval of the Local Authority
- A pre-planning submission could be required in advance of the Planning Application being lodged
- Where appropriate the proposal may be presented to the adjoining owners
- Preliminary light studies may have to be carried out in advance of the planning application.
Additional Services that may be required which lie outside the scope of fees are:
- Daylight studies in relation to the adjoining owners
- Detailed computer renderings required by the local authority.
02. - APPEALS
Should a third party lodge an objection to the Planning Application OR the applicant [the client] wish to appeal the decision or any condition attached to the decision, the application will be sent to An Bord Pleanala. The Bord takes from 3-6 months to make decisions. This only applies where an objection has been lodged.
Fees in relation to appeals will be based on time charges.
On foot of a receipt of Planning Permission Planning Conditions or Appeals additional services may be required which lie outside the scope of fees:
- Carrying out significant amendments or alterations to the design required by either the Local Authority Planning Department or the Client or in relation to Appeals.
The Planning Process:
Planning permission outcome takes a total of 12 weeks from date of lodging the planning application. Assuming no additional information is requested and there are no objections. The planning Authority will make a decision on the planning application lodged to the Local Council office within a period of 8 weeks. Anybody may submit an objection or observation with regard to the application. This must be submitted within the first 5 week period. The decision on the application will be given to the applicant and anybody who submitted an observation or objection in writing to it. After the decision on the application is made (8 weeks), if there are no appeals to An Bord Pleanála, then within four weeks of the date of this decision, you will get final grant of permission from the local authority.
If Additional Information is requested at the eight week period this will delay the process by six weeks. This may be asked because of an observation or objection made within the first five weeks, or information asked for by a Senior Planner. If minor, I will attend to at no cost. If major I will require a fee for time spent.
An Bord Pleanála
If the planning is granted and one of the people who objected wishes to pursue this matter with An Bord Pleanála this will delay the process by six months.
